These Terms & Conditions (“Terms”) apply to all customers (“Customer”, “you” or “your”) who use any storage, collection, delivery, moving, packing, relocation, luggage storage, warehouse, fulfilment or related service provided by Storage Phnom Penh (“Storage Phnom Penh”, “we”, “us” or “our”).

By booking a service, requesting collection or delivery, placing goods into storage, making payment, or otherwise using our services, you confirm that you have read, understood and agreed to these Terms.


1. OUR SERVICES

Storage Phnom Penh provides storage and related logistics services in Phnom Penh and surrounding areas.

Our services may include:

  • Personal storage
  • Business storage
  • Furniture storage
  • Vehicle storage
  • Event storage
  • Luggage storage
  • Student and traveller storage
  • Expat storage
  • House moving
  • Office relocation
  • Packing and unpacking
  • Packing supplies
  • Furniture wrapping and protection
  • IT equipment collection and recycling
  • Furniture disposal
  • Rubbish removal
  • Archive and document storage
  • Parcel receiving and holding
  • Warehouse space rental
  • Inventory management
  • E-commerce fulfilment and pick-and-pack
  • Home staging and storage
  • Other services agreed between the Customer and Storage Phnom Penh

The specific services available, prices and conditions may vary depending on the Customer’s requirements.


2. BOOKING AND ACCEPTANCE

A booking is considered accepted when Storage Phnom Penh confirms the service with the Customer.

We reserve the right to decline a booking where:

  • The requested service is unavailable;
  • The goods are unsuitable for storage;
  • The goods are prohibited under these Terms;
  • The required information has not been provided;
  • The Customer has outstanding unpaid amounts;
  • The requested collection or delivery presents an unreasonable safety risk; or
  • We reasonably believe the service cannot be performed safely or lawfully.

A quotation or price estimate does not constitute acceptance of a booking until confirmed by Storage Phnom Penh.


3. CUSTOMER INFORMATION

The Customer must provide accurate information regarding:

  • Name;
  • Contact details;
  • Pickup address;
  • Delivery address;
  • Number and type of items;
  • Approximate size or volume;
  • Storage period;
  • Special handling requirements;
  • Declared value where requested; and
  • Any known risks associated with the goods.

The Customer is responsible for ensuring that the information provided is accurate.

Incorrect or incomplete information may result in additional charges or the cancellation of a service.


4. STORAGE PERIOD

The storage period begins when goods are accepted into our storage facility and continues until the goods are collected or returned to the Customer.

Storage may be:

  • Short-term;
  • Daily;
  • Monthly;
  • Long-term; or
  • For another period agreed with the Customer.

The applicable storage period and fees will be confirmed at the time of booking.

Unless otherwise agreed in writing, storage continues until the Customer requests release or return of the goods.


5. STORAGE FEES

Storage fees are charged according to the pricing communicated to the Customer.

Additional charges may apply for services including:

  • Pickup;
  • Delivery;
  • Airport delivery;
  • Handling;
  • Packing;
  • Unpacking;
  • Special handling;
  • Oversized items;
  • Heavy items;
  • Additional labour;
  • Access or retrieval;
  • Disposal;
  • Extended storage;
  • Urgent or out-of-hours requests.

The Customer is responsible for all applicable charges.


6. PAYMENT

Payment must be made according to the payment terms provided by Storage Phnom Penh.

We may require payment:

  • Before collection;
  • Before storage begins;
  • At the beginning of each storage period;
  • Before delivery or release; or
  • According to an agreed account arrangement.

Goods may not be released or delivered while material outstanding amounts remain unpaid.


7. OVERDUE ACCOUNTS

If storage fees or other charges remain unpaid after the due date, Storage Phnom Penh may:

  • Contact the Customer;
  • Suspend additional services;
  • Restrict access or release of goods;
  • Charge reasonable additional storage or administrative costs;
  • Require payment before releasing goods; and
  • Take other lawful steps available to recover outstanding amounts.

The Customer remains responsible for storage fees that continue to accrue while goods remain in our possession.


8. PICKUP AND COLLECTION

Where Storage Phnom Penh provides a collection service, we will agree a reasonable collection time with the Customer.

The Customer must ensure:

  • Someone is available to provide access where required;
  • Goods are ready for collection;
  • Goods are reasonably accessible;
  • Any building access requirements have been communicated;
  • Parking or loading arrangements are available where necessary; and
  • Special handling requirements have been disclosed.

If our team is unable to complete a collection because of circumstances caused by the Customer, an additional collection or waiting charge may apply.

Examples include:

  • No one being present;
  • Incorrect address;
  • Goods not being ready;
  • Inaccessible premises;
  • Lack of elevator or building access where required;
  • Excessive waiting time; or
  • Undisclosed oversized or unusually heavy goods.

9. DELIVERY AND RETURN OF GOODS

When the Customer requests return or delivery of stored goods, the Customer must provide reasonable notice.

Delivery is subject to:

  • Vehicle availability;
  • Driver availability;
  • Location;
  • Access;
  • Traffic;
  • Weather;
  • Size and quantity of goods; and
  • Other operational circumstances.

Delivery times are estimates unless a specific delivery appointment has been expressly confirmed.

The Customer or an authorised representative should be available to receive the goods.


10. DELIVERY TO AIRPORTS, HOTELS AND OTHER LOCATIONS

Where we agree to deliver goods to an airport, hotel, apartment, office or other third-party location, the Customer is responsible for providing accurate delivery information.

Storage Phnom Penh is not responsible for delays caused by:

  • Traffic;
  • Airport procedures;
  • Hotel procedures;
  • Building access;
  • Incorrect information;
  • Security requirements;
  • Customer unavailability; or
  • Circumstances outside our reasonable control.

Additional charges may apply where delivery requires waiting, redelivery or additional handling.


11. CUSTOMER ACCESS TO STORED GOODS

Access to stored goods may be available by prior arrangement.

Customers must not enter restricted storage areas without authorisation.

Where access or retrieval is requested, Storage Phnom Penh may charge a reasonable handling or retrieval fee where applicable.

For security and operational reasons, access may be limited to agreed times and procedures.


12. CONDITION OF GOODS

The Customer is responsible for ensuring that goods are suitable for storage.

Goods should be:

  • Properly packed where necessary;
  • Dry;
  • Clean;
  • Free from active infestation;
  • Safe to handle;
  • Properly labelled where appropriate; and
  • Suitable for the agreed storage environment.

Customers should not place wet, leaking, contaminated or hazardous goods into storage.


13. PROHIBITED ITEMS

The following items must not be stored without our express written approval and any legally required authorisation:

  • Illegal goods;
  • Stolen property;
  • Weapons;
  • Explosives;
  • Ammunition;
  • Flammable liquids or materials;
  • Gas cylinders;
  • Toxic or hazardous chemicals;
  • Dangerous substances;
  • Illegal drugs;
  • Perishable food;
  • Live animals;
  • Plants or biological materials;
  • Items containing active infestations;
  • Leaking or contaminated materials;
  • Waste or hazardous waste;
  • Unauthorised controlled substances;
  • Items that create an unreasonable fire, health, safety or environmental risk;
  • Items prohibited by Cambodian law.

Storage Phnom Penh may refuse, remove or report prohibited goods where reasonably necessary or legally required.


14. ILLEGAL OR STOLEN PROPERTY

The Customer warrants that they have lawful ownership of, or lawful authority to store, all goods provided to Storage Phnom Penh.

Customers must not store goods that:

  • Are stolen;
  • Are subject to unlawful possession;
  • Are connected to criminal activity; or
  • The Customer does not have the legal right to possess or store.

If we reasonably suspect that goods are illegal, stolen or otherwise unlawful, we may refuse to accept or release them and may notify the appropriate authorities where required.


15. HIGH-VALUE ITEMS

Customers should inform Storage Phnom Penh before storing unusually valuable items.

Examples may include:

  • Cash;
  • Jewellery;
  • Precious metals;
  • Collectibles;
  • Artwork;
  • Rare items;
  • Important documents;
  • High-value electronics; or
  • Other goods of significant monetary or sentimental value.

We may refuse to accept certain high-value goods or impose additional conditions.

Customers are strongly encouraged to obtain their own insurance for valuable property.


16. CASH, DOCUMENTS AND PERSONAL ITEMS

Customers should avoid storing:

  • Cash;
  • Passports;
  • Identity documents;
  • Bank cards;
  • Sensitive financial documents;
  • Irreplaceable personal documents; or
  • Other items that cannot reasonably be replaced.

Where such items are accepted, the Customer remains responsible for informing us of their presence and value where requested.


17. INVENTORY AND RECORDS

Where applicable, Storage Phnom Penh may record information about stored goods, including:

  • Customer name;
  • Item description;
  • Quantity;
  • Photographs;
  • Labels;
  • Storage location;
  • Collection date;
  • Delivery date; and
  • Condition information.

Customers should notify us promptly if they believe an inventory record is incorrect.


18. PHOTOGRAPHS AND CONDITION RECORDS

Storage Phnom Penh may photograph goods for legitimate operational purposes, including:

  • Inventory management;
  • Condition records;
  • Identification;
  • Pickup and delivery records;
  • Damage assessment;
  • Security; and
  • Insurance or dispute resolution.

Photographs may be retained as part of our service records.


19. DAMAGE TO GOODS

Storage Phnom Penh will take reasonable care when handling stored goods.

However, customers acknowledge that goods may be exposed to ordinary risks associated with:

  • Moving;
  • Loading;
  • Unloading;
  • Transportation;
  • Handling;
  • Stacking;
  • Storage;
  • Retrieval; and
  • Delivery.

Customers are responsible for properly packing fragile, delicate or breakable goods.

We are not responsible for damage caused by inadequate packaging, inherent defects, normal deterioration or the nature of the goods themselves.


20. FRAGILE ITEMS

Customers must identify fragile or delicate items before collection.

Where appropriate, Storage Phnom Penh may recommend:

  • Protective wrapping;
  • Boxes;
  • Furniture protection;
  • Additional packaging;
  • Special handling.

Additional charges may apply.

Where the Customer declines recommended protective packaging, Storage Phnom Penh may not be responsible for damage that results from inadequate protection.


21. FURNITURE

Furniture should be prepared for storage where reasonably possible.

Customers are responsible for removing:

  • Food;
  • Liquids;
  • Perishable materials;
  • Personal belongings;
  • Hazardous materials; and
  • Other items that should not remain inside furniture.

Where furniture is stored with contents inside it, Storage Phnom Penh may not be responsible for damage caused by unsecured or improperly stored contents.


22. ELECTRONICS AND ELECTRICAL EQUIPMENT

Customers should ensure that electrical and electronic equipment is:

  • Clean;
  • Dry;
  • Properly packed;
  • Disconnected;
  • Free from leaking batteries; and
  • Suitable for storage.

Storage Phnom Penh is not responsible for deterioration, battery leakage, data loss or equipment failure caused by the inherent characteristics or condition of electronic equipment.


23. VEHICLE STORAGE

Where vehicle storage is provided, separate conditions may apply.

The Customer must provide accurate information regarding:

  • Vehicle type;
  • Registration;
  • Condition;
  • Keys;
  • Fuel level;
  • Alarm systems;
  • Mechanical condition; and
  • Any known defects.

Unless expressly agreed otherwise, Storage Phnom Penh is not responsible for mechanical deterioration, battery discharge, tyre pressure loss or other ordinary consequences of a vehicle remaining stationary for an extended period.

Vehicles must be legally owned or lawfully possessed by the Customer.


24. LUGGAGE STORAGE

Luggage storage is charged according to the applicable pricing communicated by Storage Phnom Penh.

Current website pricing includes luggage storage charged per suitcase, with hourly, daily and long-term options. (Storage Phnom Penh)

Customers must not place prohibited or hazardous goods inside luggage.

The Customer remains responsible for the contents of their luggage.


25. BUSINESS AND INVENTORY STORAGE

For business customers, Storage Phnom Penh may provide inventory, warehouse, archive, fulfilment or related services.

The Customer is responsible for providing accurate inventory information and instructions.

Where we provide pick-and-pack or fulfilment services, additional terms may apply regarding:

  • Inventory counts;
  • Picking;
  • Packing;
  • Dispatch;
  • Returns;
  • Delivery;
  • Damaged goods;
  • Stock discrepancies; and
  • Customer orders.

26. DOCUMENT AND ARCHIVE STORAGE

Customers storing documents remain responsible for determining which documents should be retained and for complying with any applicable legal retention requirements.

Storage Phnom Penh does not provide legal, accounting or regulatory advice regarding document retention.

Customers should retain copies of critical documents where appropriate.


27. PACKING AND PACKAGING

Where Storage Phnom Penh provides packing or wrapping services, the service will be performed with reasonable care.

Customers may request additional packaging materials or protection.

Additional charges may apply for:

  • Boxes;
  • Tape;
  • Bubble wrap;
  • Furniture covers;
  • Protective materials;
  • Special packaging;
  • Additional labour.

28. MOVING AND RELOCATION SERVICES

Where we provide moving or relocation services, the Customer must provide accurate information regarding the property, access and goods to be moved.

Additional charges may apply where circumstances differ materially from those described at booking.

Examples include:

  • Additional floors;
  • No elevator;
  • Long carrying distances;
  • Restricted vehicle access;
  • Additional goods;
  • Heavy or oversized goods;
  • Additional labour;
  • Waiting time;
  • Special handling.

29. CUSTOMER RESPONSIBILITY FOR ACCESS

The Customer is responsible for ensuring that Storage Phnom Penh has reasonable access to the collection or delivery location.

The Customer must notify us about:

  • Stairs;
  • Elevators;
  • Narrow entrances;
  • Restricted parking;
  • Security gates;
  • Building booking requirements;
  • Loading restrictions;
  • Access codes;
  • Other relevant restrictions.

Failure to disclose access restrictions may result in additional charges or an inability to complete the service.


30. LOST OR STOLEN GOODS

Storage Phnom Penh will take reasonable security measures to protect stored goods.

However, we cannot guarantee that theft, loss or damage will never occur.

Customers are encouraged to obtain appropriate insurance for their goods.

Where a loss or theft is suspected, the Customer should notify Storage Phnom Penh promptly so that the matter can be investigated.


31. INSURANCE

Unless expressly stated in writing, Storage Phnom Penh does not provide comprehensive insurance covering the full replacement value of stored goods.

Customers are responsible for arranging their own insurance where appropriate.

Customers should ensure that their insurance covers:

  • Storage;
  • Transportation;
  • Loading and unloading;
  • Theft;
  • Accidental damage;
  • Fire;
  • Water damage; and
  • Other risks relevant to their goods.

32. LIMITATION OF LIABILITY

Storage Phnom Penh will take reasonable care in providing its services.

To the maximum extent permitted by applicable law, Storage Phnom Penh is not responsible for loss or damage caused by:

  • The inherent nature of goods;
  • Inadequate packaging;
  • Normal deterioration;
  • Hidden defects;
  • Customer negligence;
  • Incorrect information;
  • Prohibited goods;
  • Unauthorised access;
  • Acts of third parties outside our reasonable control;
  • Events beyond our reasonable control; or
  • Failure by the Customer to follow reasonable instructions.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.


33. INDIRECT OR CONSEQUENTIAL LOSS

To the extent permitted by applicable law, Storage Phnom Penh is not responsible for indirect or consequential losses, including:

  • Loss of business;
  • Loss of profits;
  • Loss of contracts;
  • Loss of opportunity;
  • Loss of anticipated savings; or
  • Other indirect financial losses.

This does not affect any rights that cannot legally be excluded.


34. UNCLAIMED OR ABANDONED GOODS

Customers must collect or arrange delivery of their goods when the agreed storage period ends or when requested by Storage Phnom Penh.

Where goods remain in storage after the Customer has failed to pay outstanding amounts or has failed to respond to reasonable attempts to contact them, Storage Phnom Penh may take lawful steps to recover the outstanding balance.

Where permitted by applicable law, this may include:

  • Continuing to charge storage fees;
  • Restricting access;
  • Requiring payment before release;
  • Arranging disposal; or
  • Selling goods to recover outstanding amounts.

Storage Phnom Penh will make reasonable efforts to contact the Customer before taking such action.

If payment remains outstanding for 30 days after the due date, Storage Phnom Penh reserves the right, subject to applicable law and after providing reasonable notice to the Customer, to dispose of or sell the stored goods to recover outstanding storage fees, charges and reasonable costs.


35. CUSTOMER CONTACT DETAILS

Customers must ensure that Storage Phnom Penh has current contact information.

Customers should promptly notify us of changes to:

  • Phone number;
  • Email address;
  • Telegram contact;
  • Residential address;
  • Business address; or
  • Emergency contact information.

We may rely on the latest contact information provided by the Customer.


36. SUBCONTRACTORS AND THIRD-PARTY SERVICES

Storage Phnom Penh may use employees, contractors, drivers, movers or other service providers to deliver certain services.

Customers authorise us to use appropriate third-party providers where reasonably necessary to fulfil a booking.

Where a third-party provider is used, we will take reasonable steps to ensure the service is appropriately managed.


37. FORCE MAJEURE

Storage Phnom Penh is not responsible for delays, loss, interruption or inability to provide services caused by circumstances beyond our reasonable control.

These may include:

  • Natural disasters;
  • Flooding;
  • Fire;
  • Severe weather;
  • Government restrictions;
  • Civil unrest;
  • War;
  • Epidemics or pandemics;
  • Road closures;
  • Major traffic disruption;
  • Power outages;
  • Security incidents;
  • Facility closures;
  • Labour disruptions; or
  • Other circumstances beyond our reasonable control.

Where practical, we will notify affected customers and take reasonable steps to minimise the impact.


38. CUSTOMER COMPLAINTS

Customers should report any complaint, missing item or suspected damage as soon as reasonably possible.

Where goods have been delivered, Customers should inspect them promptly and notify Storage Phnom Penh of any visible issue.

Complaints should include:

  • Customer name;
  • Booking information;
  • Description of the issue;
  • Relevant photographs;
  • Item information; and
  • Any other supporting evidence.

Storage Phnom Penh will make reasonable efforts to investigate legitimate complaints.


39. PRIVACY AND PERSONAL INFORMATION

Storage Phnom Penh may collect personal information necessary to:

  • Process bookings;
  • Arrange pickup and delivery;
  • Manage storage;
  • Process payments;
  • Contact Customers;
  • Maintain inventory records;
  • Provide customer support;
  • Maintain security; and
  • Comply with legal obligations.

We will take reasonable steps to protect personal information from unauthorised access, use or disclosure.


40. WEBSITE INFORMATION AND PRICING

Information published on the Storage Phnom Penh website is provided for general information.

Prices, availability and service conditions may change from time to time.

A Customer’s confirmed quotation or booking will generally determine the price applicable to that booking.

Where a website price differs from a confirmed quotation, the confirmed quotation will apply unless otherwise agreed.


41. PRICE BEAT GUARANTEE

Where Storage Phnom Penh advertises a price-beat offer, eligibility is subject to verification.

A competing quotation must be:

  • Genuine;
  • Current;
  • Comparable;
  • For substantially the same service;
  • From a legitimate provider; and
  • Capable of being verified.

Storage Phnom Penh reserves the right to determine whether a competing quotation qualifies.

The price-beat offer may not apply to special promotions, incomplete quotations, substantially different services, hidden fees or offers that cannot reasonably be verified.


42. CHANGES TO SERVICES

Storage Phnom Penh may introduce, modify or discontinue services from time to time.

Where a change materially affects an existing confirmed booking, we will make reasonable efforts to notify the Customer and provide an appropriate alternative where possible.


43. CHANGES TO THESE TERMS

Storage Phnom Penh may update these Terms from time to time to reflect:

  • Changes to our services;
  • Operational changes;
  • Security requirements;
  • Changes in applicable law;
  • New services; or
  • Changes to our business practices.

The latest version published on our website will apply to future bookings.


44. GOVERNING LAW

These Terms shall be governed by the laws of the Kingdom of Cambodia.

Any dispute arising from these Terms or our services should first be raised directly with Storage Phnom Penh so that the parties may attempt to resolve the matter in good faith.

Nothing in these Terms limits any rights or remedies that cannot legally be excluded under applicable Cambodian law.


45. SEVERABILITY

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or removed to the extent necessary, and the remaining provisions will continue to apply.


46. ENTIRE AGREEMENT

These Terms, together with any confirmed quotation, booking confirmation or additional written service agreement, constitute the agreement between Storage Phnom Penh and the Customer regarding the relevant service.

Where a specific written agreement contains terms that conflict with these Terms, the specific written agreement will apply to the extent of the conflict.


47. ACCEPTANCE

By booking a pickup, placing goods into storage, making payment, requesting delivery or otherwise using Storage Phnom Penh services, the Customer confirms that:

  1. They have read and understood these Terms;
  2. They agree to comply with these Terms;
  3. They have the legal right to store the goods;
  4. The information provided to Storage Phnom Penh is accurate;
  5. They have disclosed any relevant risks or special handling requirements;
  6. They understand that storage and transportation involve inherent risks;
  7. They accept responsibility for prohibited or improperly packaged goods; and
  8. They agree to pay all applicable storage, handling, pickup, delivery and other charges.
